September and the Texas Standard Possession Order

Intro

Hello everyone. Welcome back to the review of the month of September for the Texas Standard Possession Order. Summer is over and it is back to the grind. We are back in school and so we are getting to the meat and potatoes of the Texas Standard Possession Order. A few thoughts for this month – there will be a weekend that’s going to be extended by a federal holiday. We are going to have our Thursday periods of possessions back in full force and effect because we know that Thursdays are only during the school term, right? And then, of course, we’ll have our first, third and fifth Fridays of the month and we’re going to have a fifth Friday. Surprise! Spoiler… So let’s see what we’ve got.

Thursdays

As always, custodial parent, you are in blue; non-custodial parent, you are in yellow. Let’s begin with Thursdays. There will be five Thursdays this month. I think the kids are all back in school by September 1st. If for some reason your kids are not, then the Thursdays would start after they return to school because we know that the Thursday periods of possession are during the school term. So non-custodial parents your Thursdays would be September 1st, September 8th, September 15th, September 22nd, and September 29th.

Weekends

Then we have our first, third, and fifth Fridays of the month. And yes, there are five Fridays this month. So September 2nd is the first Friday. The third Friday is September 16th and the fifth Friday is September 30th. Note that there will be a first Friday, the very following week in October. So there will be back-to-back weekends for the non-custodial parent because that will be the first Friday of October.

Weekend Extended By Holiday

Finally, let’s talk about Labor Day. Labor Day is a federal holiday. So if a weekend possession of the non-custodial parent is extended by a federal or state holiday, which this one is, then the visitation is also extended. So rather than the return being Sunday at 6:00 pm, it would be Monday at 6:00 p.m. If the return is returned to school Monday morning, then it would be returned to school Tuesday morning. So the weekend for the non-custodial parent in this scenario is extended by the federal holiday.

Closing

So there you have it – the month of September. I mean, it’s a pretty straightforward month, but there’s a lot going on in the month. So remember, we have a weekend extended by a holiday, and that provision in the standard possession order, it’s that one little paragraph that’s in there that talks about a weekend that’s extended by a holiday. We’ve got our Thursdays kicking in. As a reminder, Thursdays are only during the school term. And then we have our first, third, and fifth Fridays of the month, which continue throughout the year, throughout the summers, people, which is a question I get all the time, weekends continue throughout the summer and we have five of those (Fridays) in September.

So while it is a pretty straightforward standard visitation month there, it is a bit busy. So stay tuned. I will see y’all soon in October and let’s see what October holds.
